Ch 5 - Fourteenth Amendment

The Fourteenth Amendment has two important parts, (1) the 'equal protection' clause and (2) the 'due process clause'. 
Define each of these.
Explain which one is most important and why.

According to the Edwards book (pg.732) the 'equal protection' clause "emphasizes that the laws must provide equivalent protection to all people and there should be equal protection of life, liberty, and property to all a state's citizens." The 'due process clause' "guarantees that persons cannot be deprived of life, liberty, or property by the United States or state governments without due process of law." I think that the 'due process clause' is more important because it prevents the government from taking away citizens' rights, limits the control of the government, and gives freedom to the people.

    1. While I agree that both the equal protection clause and the due process clause are important, I think that the equal protection clause is most important. The equal protection clause is apart of the 14th amendment and ultimately gives equal protection of life, liberty, and property for all. This is important because it gives everyone equal protection of the laws and doesn't give any one person or group unfair benefits. For example, a state cannot confiscate an African American property under the law while letting Whites keep theirs or otherwise give Whites privileges denied to African Americans. (Edwards 148)

    2. I agree with Danielle. I think that the due process clause is more important because it helps limit the power of government and puts protections back into the people. I think if we didn’t have the due process clause then the government could abuse its power and limiting the government’s power and putting power and protections back into the people is very important.

  2. I believe that the equal protection clause is the most important, because without it citizens could be denied their rights without constituitional backing. The law wouldnt have to protect everyone.
