Ch 4 - Freedom of Speech

What did the Supreme Court say in Barron v Baltimore?
What did the Supreme Court rule in Gitlow v New York?
Which ruling do you agree with and why?

  1. In Barron v. Baltimore, in 1833, the Supreme Court ruled that the Bill of Rights restrained only the national government, not the states and cities. In Gitlow v. New York, in 1925, the Supreme Court rules that due to the due process clause in the Fourteenth Amendment, freedoms of the press and speech applied to the states as well as the federal government. I agree with the rulings of Gitlow v. New York because I think that states have to accept and protect the basic rights given to the citizens just like the federal government does.

    1. I also agree with the ruling of Gitlow v. New York because freedom of speech and press are rights that shouldn't be taken away from us by the states. In the 14th Amendment the due process protects us from the states taking away these rights of ours. I agree with Melissa that the states should have to protect us like the federal government does.

    2. I agree with Barron v Baltimore that the Bill of Rights should not account for the states. The states should get to make their own decisions. They should be allowed to decide what can be done on their own land. The states will make the right choices on what they think is appropriate. This is will make each state special and unique in its own way.

    3. I agree that the Bill of Rights should apply to the states. I don’t think the states or anyone should take away from our basic rights that are in the Bill of Rights. I think Gitlow V. New York was a good decision. I think that the Bill of Rights was created to limit the federal government but I think it was also created so the citizens felt protected.
