Ch 2 - Marbury v Madison

Judicial review was made constitutional through the Marbury v Madison decision. Why this a good decision by the U.S. Supreme Court?

  1. There are many reasons why the decision to make judicial review constitutional was a wise one for America. Judicial review allows judges to protect the constitutional rights of American citizens based on how they interpret the constitution. Supreme court judges are just the right people for this job because they do not need to compromise their positions. Since they are not elected, they don’t need to worry about raising money for reelection and can focus solely on their job. Since the people don’t particularly have a say in who is a judge, the judges do not have to worry about upsetting specific groups of people when making a decision and therefore are typically unbiased. The decision made in the case was one in favor of democracy. Judicial review seeks to protect the powers of the people and gives the Supreme Court a way to check Congress and the executive branch in order to keep them from oppressing citizens.

  2. I agree that making judicial review constitutional was a good idea for all of the reasons listed by Erin. Lord Hoffman said that, "The principles of Judicial Review gives effect to the Rule of Law. They ensure that administrative decisions will be taken rationally in accordance with a fair procedure and within the powers conferred by Parliament"(lawteacher.net).
